原标题：如何进行波兰专利申请？

波兰现行专利制度的主要法律是《工业产权法》，同时也是《巴黎公约》的成员国。波兰的专利保护类型分为三类：发明专利，实用新型专利和外观设计专利。其中，发明专利的保护期为20年；实用新型专利保护期为10年；外观设计专利的保护期为自申请日起自动受到5年保护，并且可以续展4次，每次5年，最长不能超过25年。波兰专利申请接受的语言是波兰语。

一、波兰专利申请的审查制度

1.发明专利

波兰发明专利的申请流程与中国相似。不同之处在于波兰专利申请人需要在申请日后的三个月内提交要求优先权的声明，并提交证明其已在指定的国家或场合在先申请的文件。而中国的优先权声明必须在提交申请时一起提交给专利局。

专利局首先对波兰专利申请进行形式审查和新颖性检索，并作出检索报告。波兰专利申请在申请日或优先权日后18个月公布，申请人可以在优先权日后12个月提出提前公布的要求。经专利局实质审查后，授予专利权。

2.实用新型专利

波兰实用新型专利的申请流程比中国严格一些，其流程与上述发明专利基本相同。

专利局首先进行形式审查和检索，并生成检索报告。专利局在申请日（或优先权日）起18个月后公布该波兰专利申请；在优先权日之后12个月，申请人还可以要求专利局提前公布，但必须支付额外费用。

专利局对实用新型专利申请进行实质审查，但主要审查新颖性。满足要求的颁发实用新型专利证书，对实用新型专利进行保护，前提是波兰专利申请人必须支付保护费，否则保护决定无效。

3.外观设计专利

波兰的外观设计专利申请流程与中国的相似，没有实质审查。从受理申请日起三至四个月，将对波兰专利申请进行形式审查，并且主管局不会自动进行检索。但是，当主管局认为波兰专利申请有实质性驳回的理由时，也可以根据实质性理由驳回该波兰专利申请。在审查期间，必须支付保护费和公开费。

二、波兰专利申请的渠道

1.发明专利

中国向波兰申请发明专利的方式分为以下两种：

（1）pct渠道

pct国家申请；

pct指定epo申请指定国家。

（2）《巴黎公约》渠道

国家申请；

epo申请指定国家。

2.实用新型专利

中国向波兰申请实用新型专利的方式是《巴黎公约》。

3.外观设计专利

中国向波兰申请外观设计专利的方式有两种：

（1）巴黎公约渠道：国家申请。

（2）ohim渠道：欧共体外观（rcd）。

3.designpatents
